[Vietnam] Designation of Conformity Assessment Bodies under Decree 37/2026/ND-CP: Conditions, Dossier and Procedure

Decree 37/2026/ND-CP on detailed regulations implementing the Law on Product and Goods Quality has brought conformity assessment activities for state management to a new framework, in which “designation” becomes a mandatory condition for a testing laboratory, certification body, inspection body or verification body to participate in the sequence of conformity assessment for products and goods with high risk levels. Previously, businesses often understood this activity as a separate administrative procedure for each ministry and each place. Decree 37/2026 brings these into a single, coherent framework: competence conditions, dossier, procedure, time limits, maintenance obligations and grounds for revocation.

This article is our synthesis and analysis of Section 2 Chapter VI (Article 71 to Article 77) of the Decree, combined with practical experience working with testing laboratories and certification bodies in Vietnam. The content includes four main parts: who is designated and who designates; Capacity conditions according to each type of organization; documents, procedures and deadlines; and obligations arising after designation, including in the event of revocation.

Before going into details, it is necessary to clearly state a principle: Decree 37/2026/ND-CP was signed on January 23, 2026 and according to Article 97, Clause 1, the Decree takes effect from the date of signing; old decrees in this field including Decree 132/2008/ND-CP, Decree 74/2018/ND-CP, Article 4 of Decree 154/2018/ND-CP and Decree 13/2022/ND-CP expire from July 1, 2026. Therefore, enterprises that are conducting conformity assessment activities and enterprises that are using conformity assessment results should consider the provisions in Articles 71 to 77 as the applicable framework, not the upcoming documents.

1. Scope of designation: when designation is mandatory

Article 71, Clause 1 defines two conditions for a conformity assessment body to participate in conformity assessment to serve state management: first, the organization has registered to operate in accordance with the law on standards and technical regulations; second, the organization is designated by a competent state agency according to this Decree.

These two conditions do not replace each other. A testing laboratory with a Certificate of registration for testing activities, even if it has been recognized for the correct scope, is still not enough for its testing results to be used for the purpose of declaring conformity to products and goods with a high risk level, if that testing laboratory has not yet had a designation decision from the corresponding line ministry.

The Decree also limits the scope of application of the designation mechanism: designation is carried out in cases where national technical regulations or specialized laws require a conformity assessment body to be designated. In other words, the designation mechanism does not apply universally to all testing and certification activities, but is associated with areas where the law imposes such requirements – usually areas with products in the high-risk group and with corresponding national technical regulations.

An example being applied is the field of electric vehicle charging posts and charging stations: QCVN 32:2026/BCT (issued together with Circular 61/2026/TT-BCT) sets out the obligation to declare conformity for charging posts and charging stations, with requirements on methods of assessing conformity and use of results by designated organizations. We have analyzed this standard in the article QCVN 32:2026/BCT – Regulations on electric vehicle charging posts and charging stations: analysis and things to prepare before July 1, 2027.

The objects of the designation are the five types of activities listed in Article 71, paragraph 2: testing, inspection, certification, verification and validation. This is where businesses often get confused: the same organization can be assigned to one or more types, and the scope of designation for each type is different, corresponding to each technical regulation, each product group and each test method.

Type Nature of work Output products
Test Measure and check technical specifications according to testing methods Test result card
Inspection Review and determine the actual condition of the object Inspection certificate
Certification Evaluate the conformity of products or management systems Certificate
Check confirmation Check and confirm shipments and specific objects Test results confirmed
Confirm value of use Evaluate the actual usability of products and goods The results confirm the validity of use

2. Who has the authority to designate

Article 71, Clause 2 assigns the authority to designate line ministries to implement products and goods with high risk levels in assigned industries and fields, according to the requirements of national technical regulations or specialized laws. The agency is collectively known as the “designating agency”, and during the process of processing the application, this agency must ensure that the designated organization meets the conditions prescribed by law.

For local technical regulations (QCDP), Article 71, Clause 6 assigns the People’s Committee of provinces and cities to designate certification bodies according to the order and procedures of this Decree and publicly announce the list of designated conformity assessment bodies. This is a noteworthy point for localities that have their own standards and for certification bodies that want to participate in the local market.

An important management mechanism is located in Article 71, Clause 3: Line ministries and People’s Committees of provinces and cities are responsible for publicly publishing on their databases, connecting with the National Database on standards, measurement, and quality, and periodically updating before the 25th of every month, two lists: list of designated conformity assessment bodies; and a list of unilateral conformity assessment bodies recognized by line ministries according to the law on standards and technical regulations.

For businesses, this regulation turns something that previously had to be asked from place to place into something that can be looked up publicly, and more importantly, looked up periodically, because the list is updated monthly. Before signing a testing or certification contract for a shipment belonging to a high-risk group, checking whether the supplier’s name is on the list with the correct scope and is still valid is a step that should be included in the internal process.

Article 71, Clause 4 sets out the principle of priority and recognition of competence assessment results among ministries, including four contents: if a line ministry has assessed actual competence and designated an organization, other ministries are responsible for reviewing and using that assessment result within their scope of management; Prioritization, consideration, and use must ensure no overlap, do not give rise to administrative procedures, and be consistent with specialized fields; If consensus cannot be reached, the Ministry of Science and Technology shall preside over and coordinate with relevant ministries to consider and propose a unified solution; and if there are still different opinions, the Ministry of Science and Technology reports to the Prime Minister for consideration and decision.

In practice, this principle is most useful for organizations that are already designated in one area and want to expand into an area managed by another ministry: instead of starting from scratch, the organization can request to recognize the results of an existing competence assessment. Article 75, Clause 1, Point b, concretizes this principle with a timeline: recognition of assessment results is only valid for a period of 12 months from the date the competent authority issues the most recent assessment results.

Designation conditions are tied to genuine competence: formal staff according to the definition of the labor contract, equipment with valid inspection – calibration and proficiency testing results.

3. Designation conditions by type of organization

Article 72 stipulates the conditions for designation according to four groups: testing organization; certification bodies, testing and validation organizations and validation organizations; and inspection body. The condition structure has three general layers: certificate of registration to operate in the designated registered field; accredited by a registered accreditation organization for the designated registration scope; and conditions for professional personnel and results of proficiency testing or interlaboratory comparison.

Testing organizations

Article 72, paragraph 1, sets out four conditions. First, the organization has been granted a certificate of registration for testing activities according to the law on standards and technical regulations, including the designated testing field. Second, the organization must be recognized by an accreditation organization that has registered to operate in accordance with the law on technical standards and regulations and the assigned sector to serve the state management requirements of the line ministry (if any) for the scope of registration for testing designation.

Third, the organization has satisfactory results of participating in proficiency testing or inter-laboratory comparison for the testing methods of products and goods registered for designation. Fourth, the organization has at least 06 official testers with at least 02 years of experience working in the field of registered testing.

The definition of “official” here is clearly stated by the Decree and businesses need to read it carefully because this is a point that is often miscounted: personnel are counted as public employees, or workers who sign labor contracts to perform professional work with a definite term of 12 months or more, or workers who sign labor contracts with an indefinite term. Short-term contracts, case-based collaborators or affiliated unit personnel are not included in the minimum number of 06 people.

Certification bodies

Article 72, clause 2, point a, requires organizations that have been granted a certificate of registration to certify, verify and confirm use value according to the provisions of law on standards and technical regulations, and must be recognized for the designated registration scope.

For certification bodies, personnel conditions include two parts. In terms of quantity, the organization must have at least 06 official evaluators, with the “official” determination as above. Regarding experience, experts must have at least 20 working days of experience evaluating products and goods registered for designation.

For new management system certification programs, the Decree allows the use of equivalent experience but with strict conditions: experts must have at least 20 man-days of assessment experience for certification programs of other management systems of the same nature, logic or in the same field, or have at least 05 man-days of assessment experience for registered certification programs.

For new product certification programs, or products registered for additional certification activities, experts must have at least 05 working days of experience evaluating products of the same type, understood as products with similar uses or belonging to the same classification group according to HS code, product industry code or according to corresponding national technical regulations, and with the same technology, understood as products with similar production processes, constituent materials, technical structure or operating principles.

When experts use assessment experience for certification programs of other management systems as a substitute, the Decree requires that those management systems must be determined to have the same nature, logic or belong to the same field, meeting one of three criteria: built according to the same standard structure issued by the International Organization for Standardization (ISO); have the same specialized field and scope of management as quality management system group, environmental management system group, food safety management system group, occupational health and safety management system group, information safety management system group; or have similar management goals, internationally recognized in guiding documents of the International Accreditation Forum (IAF), the International Laboratory Accreditation Organization (ILAC) or other regional and international accreditation cooperation organizations.

Verification bodies and bodies validating use value

For this group, the personnel requirements include a minimum of 06 official assessment experts and a minimum of 10 working days of assessment experience in the field of verification and validation of designated registration.

Inspection bodies

Article 72, Clause 3 stipulates three conditions: having been granted a certificate of registration for inspection activities according to the law on standards and technical regulations, including the field of designated inspection registration; must be accredited by an accreditation organization that has registered to operate within the scope of registration for inspection designation; and have at least 06 official appraisers, each with at least 02 years of experience directly performing appraisal of objects in accordance with standards and technical regulations, with a minimum of 20 days of appraisal work confirmed by the appraisal organization.

Core conditions Test Certification Verification and validation testing Inspection
Register to operate in the right field Yes Yes Yes Yes
Recognized in the right scope Yes Yes Yes Yes
Minimum number of formal staff 06 testers 06 expert reviews 06 expert reviews 06 assessors
Minimum HR experience 02 years in the testing field 20 working days to evaluate registered products and goods 10 man-days in the field of registration 02 years of inspection, of which 20 working days are confirmed
Proficiency testing or interlaboratory comparison Yes, for registration test method No separate regulations No separate regulations No separate regulations

4. Designation application dossier

Article 73 sets out the dossier for five cases: first-time designation; temporary testing designation; change, addition or narrowing of the designated scope or field; re-issuance of a designation decision; and re-designation when a designation decision is about to expire.

First-time designation

The initial designation dossier includes seven components. First, the application for registration of conformity assessment activities according to Form No. 4, Appendix VII. Second, a copy of the Certificate of registration for testing, inspection, certification, verification and validation activities. Third, a copy of the Accreditation Certificate of the accreditation organization for the corresponding designated registration scope.

Fourth, list of testers, assessment experts, and assessors according to Form No. 7, Appendix VII, with a copy of the professional training certificate. Fifth, list of technical documents, standards and processes, testing procedures, inspection, certification, verification and validation according to Form No. 8, Appendix VII, with copies of processes and procedures corresponding to the products, goods, processes and environments registered for designation.

Sixth, for testing organizations, the list of testing machinery and equipment for the designated registration field is according to Form No. 9, Appendix VII, with a copy of the valid Inspection and Calibration Certificate and proof of ownership or long-term rental of testing equipment. Seventh, for testing organizations, copies of proficiency testing results or inter-laboratory comparisons for testing methods of products and goods registered for designation, with at least 02 other testing organizations designated or recognized according to TCVN ISO/IEC 17025 or ISO/IEC 17025 standards.

The last two components are the most time-consuming in practice. Obtaining proficiency testing results or interlaboratory comparisons with at least two other organizations, for the correct registration test method, usually requires a much longer preparation cycle than an internal test, because there must be a suitable program, homogeneous samples and time to compare results. Similarly, proving valid calibration and testing and the right to use equipment (owned or long-term lease) requires documents to be updated before submission, and cannot be added later.

Temporary testing designation

Article 73, Clause 2 stipulates that the ministry managing the industry or field decides on the temporary designation of a testing organization to serve the needs of testing new criteria, and is responsible for this decision. The temporary designation decision is valid for 6 months from the date of signing. The dossier includes a registration application according to Form No. 4, Appendix VII; Copy of the issued decision to designate a testing organization; and test method records, confirming the validity of test methods and standards for testing quality control.

This is a path that needs to be better known in practice: when a new standard has a new criterion and no organization has been designated for that criterion, the temporary designation mechanism allows to address the competence gap in a short period of time, provided that the testing organization has a foundation in test methods and standards.

Changes, additions or narrowing of the designated scope

The dossier includes an application to change, supplement, narrow the scope or designated field, or expand the facility or location for conformity assessment according to Form No. 11, Appendix VII; A copy of the operation registration certificate and a copy of the Decision designating a conformity assessment body; list of testers, assessors, and assessment experts for the scope and fields registered for changes and additions according to Form No. 7 with a copy of the professional training certificate; list of technical documents, standards and procedures according to Form No. 8 with copies of corresponding procedures; list of machinery and testing equipment according to Form No. 9 with a copy of the valid inspection, calibration and testing certificate; A copy of the Certificate of competence recognition for the scope and field registered for change or supplementation; and a copy of the results of proficiency testing or interlaboratory comparison for test methods registered for changes or additions to the testing organization.

Re-issuance of a designation decision

In case the designation decision is still valid but is lost, misplaced, damaged, or the organization changes its name, address, the documents must be submitted according to Form No. 12, Appendix VII. If requesting re-issuance due to change of name or address, the organization must submit additional documents proving the change, including one of the following documents: Business registration certificate, Investment registration certificate or other valid documents according to the provisions of law. If you request a reissue due to loss, misplacement, or damage, the dossier will only include an application according to Form No. 12.

Re-designation when the validity period is about to expire

Article 73, Clause 5 stipulates that before the designation decision expires, within 60 days, if there is a need, the conformity assessment body must compile a dossier as in the case of first-time designation. As for the designated testing organization, the application for re-designation must be accompanied by documents proving that it has participated in the proficiency testing program or inter-laboratory comparison at least once for the designated testing field.

This 60-day mark is the point that businesses need to include in their internal compliance schedule, because re-designation documents are processed like initial designations, meaning that actual competence may have to be assessed, there is time to fix it, and there is time to issue a decision.

5. How the dossier is submitted

Article 74 stipulates that conformity assessment bodies when there is a need to participate in testing, inspection, certification, verification and validation activities to serve state management in a specific field, prepare 01 set of registration application for designation, submitted in the form of online public service through the National Public Service Portal. In case the National Public Service Portal is faulty or this administrative procedure has not yet completed the online public service infrastructure, the organization shall submit paper documents in the form of direct submission or via postal service.

For the filing unit, the practical consequence is two parallel sets of records: an electronic set for submission, and an internal set of records with version control, because the same data will have to be reused many times for different purposes such as designation, accreditation, periodic activity reports and monitoring reviews.

6. Designation procedure and time limits

Article 75 stipulates the order and procedures for cases of first-time designation, temporary designation, change or addition of scope and field of designation, and designation decisions that have expired. The timelines are summarized in the table below.

Step Content Deadline
1 The designating agency shall notify the request for amendments and supplements if the dossier is not complete and valid 03 working days from the date of receipt of application
2 The designating authority decides to carry out the actual competence assessment 10 working days from receipt of valid documents
3 Notify the organization in writing about the actual assessment Before evaluating
4 The expert or assessment team signs the actual assessment record and sends it to the designating agency Within 05 days after the end of the evaluation
5 The organization submits a report on corrective action results Not more than 30 days; In case it must be prolonged, report in writing, no more than 6 months
6 The designating agency issues the designation decision according to Form No. 10 if the requirements are met 05 working days from the date of receipt of the remediation report
7 Validity period of the designation decision Decided by the designating agency according to competence, but no more than 05 years from the date of signing
8 Reissue the designation decision 05 working days from receipt of complete and valid documents
9 Reassign when the validity period is about to expire Offer before the 60 day period expires

Some contents worth noting in the actual competence assessment step. The assessment is carried out on the basis of criteria on human resources, technical facilities, quality management system, operational results and legal compliance of the conformity assessment body. The actual assessment is carried out through sending experts or establishing an assessment team. The expert, or at least one member of the actual competence assessment team, must be trained on the quality management system corresponding to each type of organization registering for designation.

In case of temporary designation, change, addition or narrowing of scope, if the dossier is complete and valid, the designating agency will review the dossier and will not organize an assessment of actual competence. However, if the dossier has inappropriate content, or there is a request from a competent state agency, or there is information or feedback on signs of violations related to the dossier, the designating agency will organize an assessment of actual competence at a conformity assessment body.

The actual assessment content is differentiated according to the operating status of the organization. For organizations requesting designation for the first time, the designating agency evaluates the satisfaction of competence conditions, management system and suitability of legal documents; Do not evaluate compliance content in conformity assessment activities because the activity has not yet occurred. For an operating organization requesting re-designation or expansion of scope, the designating agency evaluates legal compliance based on the report on the results of conformity assessment activities within the most recent 03 years, or during the operating period if the operating period is less than 03 years; violation handling records, if any; and monitoring results of management agencies and accreditation agencies, if any. The designating authority also verifies the accuracy, truthfulness and completeness of the records; Separately with the testing organization, verify the current status of facilities, testers, testing equipment and professional and technical skills for the corresponding testing methods.

Regarding costs, Article 75 regulates costs for assessment activities of experts or assessment teams designated by the registration organization to ensure compliance with the principles of publicity, transparency and compliance with financial laws. The list of costs includes travel and accommodation costs, costs for hiring experts if any, costs for conducting on-site assessments and other valid costs according to regulations of the Ministry of Finance and specialized laws; Expenditure levels comply with the current financial expenditure regime.

7. Obligations when changes occur and throughout the designation period

Article 75, Clause 5 stipulates that when a conformity assessment body has a change in competence related to technical personnel, equipment, processes or quality management system during its operation, the organization must notify in writing the ministry managing the industry or field. The notification dossier includes a document clearly stating the content of the change; Documents proving competence after the change include personnel records, equipment records, and updated procedures; internal assessment report on the impact of change; and other documents as required by the line ministries. The designating agency reviews the dossier, evaluates the appropriateness of the change, evaluates the reality if necessary, and then decides to approve the change, adjust the scope of designation or request remediation.

Article 77 stipulates three groups of permanent responsibilities. First, the designated organization carries out rights and obligations according to the law on standards and technical regulations; With the designated testing organization, within the validity period of the designation decision, the organization must participate in the proficiency testing program and inter-laboratory comparison at least once for the testing field and designated products and goods.

Second, quarterly before the 25th, or irregularly when required, the organization updates the results of conformity assessment activities specified according to Form No. 13, Appendix VII on the National Database on standards, measurement and quality. Third, the organization notifies the designating agency of any changes that affect the designated conformity assessment competence within 15 days from the date of the change.

Article 71, Clause 5 adds the principle: the designated organization is responsible for maintaining competence, implementing the correct scope, methods and technical requirements according to the provisions of national technical regulations or specialized laws, and is subject to inspection and supervision by competent authorities.

8. Revocation of a designation decision

Article 76 stipulates that the ministry managing the industry or field shall consider and decide to revoke the designation decision when the conformity assessment body violates one of seven cases: 02 consecutive violations of the regulations on conformity assessment according to the law on standards and technical regulations and the provisions of this Decree; fails to fully carry out the corresponding responsibilities specified in Article 77 for 02 consecutive years; does not ensure one of the corresponding conditions for the designated organization; Forging or falsifying documents in the application for designation, issuing false conformity assessment results; erasing, correcting or falsifying the content of the issued designation decision; Failure to correct violations as requested by inspection and examination agencies; and in cases where the organization no longer operates within the designated scope, is dissolved, or self-requests withdrawal.

The time consequences are clearly stated: the organization whose designation decision has been revoked can only review the designation registration application at least 6 months after the notice of revocation and the violations have been corrected. The recall process includes the competent authority issuing a recall decision within 03 working days, clearly stating the reason; The recall decision must be sent to the relevant organization, published on the competent authority’s electronic information portal and updated in the national database on standards, measurement and quality.

The notable legal point is how the Decree separates the two situations. If the reason for recall is also an administrative violation according to the decree on sanctioning administrative violations in the field of standards, measurement, and product and goods quality, the competent agency shall issue a decision to recall and transfer the file to the inspection agency for handling and sanctioning according to the correct authority, order, and procedures. If the reason for revocation is not an administrative violation, for example the organization voluntarily withdraws or fails to maintain competence after the evaluation cycle, the competent authority will only issue a decision to revoke and not impose administrative sanctions.

9. A view from businesses using conformity assessment results

For manufacturing and importing enterprises – the parties that use testing and certification results to declare conformity – the above regulations have four practical implications.

First, conformity assessment results can only be used for state management purposes when the organization providing the results is on the designated list, within the correct scope and is still valid. Because the list is updated before the 25th of every month, businesses should check at the time of contract conclusion and check again before submitting the declaration of conformity for shipments with long time delays.

Second, risks do not just lie in testing. If the organization providing the results has its designation decision revoked because of falsification of documents or false issuance of results, the validity of the issued results becomes a legal issue for both users. This explains why keeping a record of the partner’s qualifications, including the designation decision at the time of issuance of results, is a necessary precaution.

Third, the validity period of the designation decision is a maximum of 05 years, and re-designation must be requested before the 60-day period expires. A partner in the process of re-designation may have its ability to provide services interrupted for a certain period of time, so businesses with long-term certification plans should inquire in advance about the validity status of the designation decision.

Fourth, the mechanism to recognize the results of competence assessment between ministries, with a value of 12 months, opens up the possibility of shortening the designation time when the organization has been assessed and designated by another ministry. For parties using results abroad, the principle of recognition of unilateral conformity assessment bodies recognized by line ministries according to legal regulations on standards and technical regulations is a point to look up when choosing a service provider abroad.

A short, ready-to-use checklist when working with a testing laboratory or certification body: does the unit have a valid designation decision; Decide whether to specify the correct technical standards, the correct product group and the correct test method that you need; Does the scope of accreditation correspond to the scope of designation; Whether the unit participates in proficiency testing or interlaboratory comparisons within the specified time period; Does the unit periodically update operational reports according to Form No. 13; Has the unit announced the change in competence; and finally the legal value of the results in case the designation decision is later revoked.

10. Points requiring further verification

To avoid overinterpreting the text, we highlight content that this article has not fully verified. Firstly, the signing date and specific effective date of the Decree should be compared in the Official Gazette and the National Database of Legal Documents, because our Decree has the date January 23, 2026 recorded in the appendix. Second, “recognition” under Article 72 refers to the law on standards and technical regulations; Specific accreditation standards for each type are applied by the accreditation organization and the industry management ministry, so businesses need to confirm directly with the designating agency. Third, the actual assessment cost regime is implemented in accordance with the regulations of the Ministry of Finance and specialized laws, so the specific cost level is not mentioned in this article. Fourth, the list of products and goods with a high risk level and the list of designated organizations are published for each industry and may change according to the update period, so it is necessary to look up at the time of use. Fifth, regulations on administrative order and procedures can be amended and supplemented; Readers should check the current text before applying to a particular record.

Conclusion

Articles 71 to 77 of Decree 37/2026/ND-CP create a unified designation framework for conformity assessment bodies, along three main strands: competence conditions are regulated according to the number and experience of professional personnel, associated with accreditation and proficiency testing; The order has a specific time limit for each step, from 03 working days to edit documents to 05 working days to issue a decision; and maintenance obligations are periodically reviewed, including quarterly performance reports by the 25th and 15-day notification of changes in competence.

For the conformity assessment body, the value of carefully reading these provisions lies in preparing in advance the following additional difficult points: formal staff according to the labor contract definition, equipment calibration and testing records, proficiency testing results with at least two other organizations, and a schedule for re-designation applications before the 60-day mark. For businesses using the results, the value lies in knowing clearly who they are relying on and what documents they are relying on, because the validity of the dossier declaring conformity depends directly on the validity of the designation decision at the time of issuing the results.

Three things to do immediately: (1) review the list of technical regulations you are having to declare conformity with, determine which fields require a conformity assessment body to be designated; (2) check the designation status and scope of designation of the service providers currently in use, including validity and time of issuance of results; (3) if you are a conformity assessment body, internally schedule periodic compliance milestones according to Article 77 and 60-day milestones according to Article 73, paragraph 5. These are less time-consuming but help avoid interruption of service delivery competence or having to re-do documents in the sprint phase.
